Welcome to Green Thumb Guys ("we", "us", "our"). These Terms & Conditions govern your use of our website and purchase of our products. By accessing or using our site (www.greenthumbguys.net), you agree to these terms. If you do not agree, please do not use the site or purchase our products.
1. Definitions
- Customer / You / Your: Any individual or entity who accesses the site and/or purchases goods from us.
- Products: Any goods offered for sale on our website, including but not limited to handcrafted cement planters (such as spherical and cubic designs), botanical art pieces, items within our Biophilic Collection, and general gardening or landscaping supplies.
2. Use of the Website
- You must be at least 18 years old (or the legal age in your jurisdiction) to make a purchase.
- You agree to provide accurate, current, and complete information for any registration, purchase, or transaction.
- You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account.
3. Acceptable Use
- You agree not to use the website for any unlawful, harassing, defamatory, abusive, threatening, or harmful purpose.
- Prohibited activities include, but are not limited to: hacking, data scraping, posting unlawful content, or interfering with the site's operation or security.
- We reserve the right to terminate or suspend your access to the site immediately, without prior notice, if you breach this clause.
Part A — E-Commerce & Product Sales
4. Orders & Acceptance
- Placing an order constitutes an offer to purchase a product. We reserve the right to accept or reject any order for any reason (e.g., out of stock, pricing error, inability to deliver to your area).
- Once your order is accepted, you will receive an order confirmation via email. That confirmation does not mean the goods have shipped; shipping notification will follow.
- Material Characteristics: Many of our Products are individually handcrafted from materials such as cement. Due to the nature of this process, inherent variations in color, texture, porosity, and finish are expected. These unique characteristics are standard for handcrafted concrete and botanical items and do not constitute manufacturing defects. All product representations on the website are 2D photographic depictions, and actual physical items may vary slightly.
5. Pricing & Payment
- Prices are as listed on the website at the time of purchase. Prices may change without notice.
- You are responsible for any taxes, duties, or customs fees that may apply.
- We accept payment via credit/debit cards, PayPal, and Google Pay. All payments must be authorized and clearable.
6. Shipping & Delivery
- Shipping options, costs, and estimated delivery times will be shown during checkout.
- We are not responsible for delays caused by your failure to provide correct shipping information, customs delays, or courier delays beyond our control.
- Title and risk of loss pass to you when the product leaves our warehouse (or at another defined point, if different).
- Transit Damage: While we take great care in packaging heavy and fragile items, damages in transit occasionally occur. If a Product arrives damaged, you must notify us within 48 hours of delivery and provide photographic evidence of both the damaged item and the original packaging. Failure to report damage within this window may result in the denial of a replacement or refund.
7. Returns, Refunds, & Exchanges
- If you are not satisfied with a product, you may request a return/exchange within 14 days from receipt.
- Returned products must be in their original condition, unused, with all packaging and tags.
- Refunds will be processed to the original payment method within 7 business days after receipt and inspection of the returned product.
- Shipping costs for returns may be the responsibility of the customer (unless the return is due to our error).
- Custom and Living Items: Standard Returns apply strictly to unused, non-perishable goods in original packaging. Custom-commissioned botanical art pieces and living plants (including succulents) are final sale and not eligible for return unless explicitly agreed upon in writing or if they arrive fundamentally damaged.
Part B — Landscaping & On-Site Services
8. On-Site Services & Scope of Work
- Scope of Services: Our on-site services include, but are not limited to, landscape design, project management, site preparation (including large-scale sod and patchy lawn removal), and the installation of water-wise environments, wicking garden beds, block walls, and flagstone pathways.
- Written Estimates: All service engagements will be governed by a separate, signed project estimate or written agreement detailing the specific scope, timeline, and material costs.
- Scope Changes: Any alterations to the agreed-upon scope of work, including material upgrades or structural additions, must be approved in writing and may result in adjusted timelines and fees.
- Design Deliverables: Design concepts and project plans are provided as 2D visual representations and schematics to guide installation.
- Third-Party Coordination: We may coordinate with local surveying firms, engineering firms, or specialty subcontractors to execute specific project requirements. While we manage these relationships as part of our project management scope, we are not directly liable for the independent errors, omissions, or delays of third-party professionals.
- Site Preparation and Material Staging: To facilitate efficient project execution, you agree to provide reasonable access to the property for our team, equipment, and material deliveries.
- Material Staging: Projects frequently require the staging of heavy materials (e.g., galvanized metal, lava rock reservoirs, custom soil blends, and block wall materials). We are not liable for temporary, foreseeable wear to driveways or staging areas strictly necessary to execute the approved work.
- Underground Utilities: The customer is responsible for accurately identifying and marking any private underground utilities, irrigation lines, or hazards not covered by standard municipal utility location services prior to the commencement of ground alterations or sod removal.
- Rebates and Conservation Incentives: While we specialize in water-wise landscaping, xeriscaping, and "Flip Your Strip" compliant designs, we do not guarantee the approval or receipt of state, local, or municipal water conservation rebates.
- Inspections: The customer is ultimately responsible for ensuring all formal site inspections are scheduled and completed within the necessary timeframes to qualify for applicable incentives.
Part C — General Legal Terms
9. Warranties & Disclaimers
TL;DR: We sell our products "as is." We don't guarantee the site will be error-free or that the products will meet every specific purpose you might have, beyond what the law requires.
- To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability or fitness for a particular purpose.
- We do not guarantee that the website, its content, or emails from us are error-free or that access will be continuous or uninterrupted.
- We are not liable for any loss or damage arising from using our products beyond what is reasonably foreseeable, except where prohibited by law.
10. Limitation of Liability
TL;DR: If something goes wrong, our financial responsibility to you is strictly limited to the amount you paid for the product(s) that caused the issue. We are not responsible for indirect or consequential damages.
- Our liability is limited to the purchase price of the product(s) you ordered, to the extent permitted by applicable law.
- We will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the website or the purchase of products.
11. Intellectual Property
- All content on the website (text, images, logos, graphics, designs) is our property or licensed to us, and is protected by copyright, trademark, and other intellectual property laws.
- You may not copy, reproduce, modify, distribute, or sell any such content without our express written permission.
- Ownership of Feedback: If you provide us with any suggestions, ideas, or feedback regarding our products or services, you hereby assign to us all rights, title, and interest in and to such feedback.

- These Terms & Conditions are governed by the laws of the State of Utah without giving effect to any choice of law or conflict of laws provisions.
- Any dispute arising under or in connection with these Terms shall be resolved in the courts of Salt Lake County, Utah.
14. Changes to Terms & Conditions
- We may change these Terms & Conditions from time to time. If we do, we will post the updated version on this page with a revised "Effective Date".
- For significant changes, we will notify you via email or a prominent website banner before the changes take effect.
